VitharBoost User Agreement

This agreement contains the rules required to benefit from the services on our website.
BY REGISTERING ON OUR WEBSITE, YOU DECLARE THAT YOU HAVE READ ALL AGREEMENTS, UNDERSTOOD THEIR CONTENT, ACCEPTED THEIR TERMS, AND APPROVED THEM.


A) User Agreement

1. Parties

This Agreement is concluded electronically between Yusuf Kacar Sole Proprietorship (hereinafter referred to as “VitharBoost” and/or the “Platform”) and the user who registers on the website vitharboost.com (the “Member”), for the purpose of the Member’s registration and use of the Platform services, and shall enter into force upon the Member’s electronic approval.

By registering, the Member declares and undertakes that they have read, understood, and accepted all provisions of this Agreement.

  • VitharBoost: Yusuf Kacar Sole Proprietorship (vitharboost.com)
  • Member: A natural or legal person who has created a membership account on VitharBoost.

2. Definitions

  • Market: The “Gamer Market” on vitharboost.com or the service/account/product sales platform where members can trade with each other.
  • Business Day: Days excluding weekends and official public holidays.
  • Payment Instrument: The payment institution/intermediary used to top up balance and send payments.
  • Earnings: The balance obtained in exchange for the sale of goods or services to VitharBoost and/or to members.
  • Seller: A member who posts listings for sale on the Market.
  • Buyer: A member who purchases any goods or services on the Market.

3. Subject and Scope of the Agreement

The subject of this User Agreement is to determine the scope of the services provided through VitharBoost, the conditions of benefiting from these services, and the rights and obligations of the parties. This Agreement covers the usage rules on the website, membership terms, and all explanations, warnings, and statements regarding the services. By using the website, the user is deemed to have accepted all statements and rules herein.

4. Gamer Market and General Sales Rules

  • The Seller accepts that they are authorized to sell the product or service listed on the Market and that they provide complete and accurate information.
  • During the payment and delivery process between the Buyer and the Seller, the Platform may provide certain mechanisms (e.g., payment flows, notifications, support processes) to ensure security and operational convenience.
  • The Seller is responsible for the accuracy, delivery, and any buyer grievances regarding the sold product/service.
  • The Buyer or Seller is solely responsible for any loss arising from transactions not carried out through VitharBoost; VitharBoost cannot be held liable for such transactions.
  • VitharBoost does not act as an intermediary for barter/exchange transactions on the Market.
  • All legal and financial responsibility arising from the sale of prohibited items or providing incomplete/incorrect information belongs to the Seller.
  • Digital products, game accounts, and similar content are subject to the rules of third-party game providers. Any restrictions, bans, suspensions, or similar actions imposed by third-party providers are under the responsibility of the Seller and/or the relevant provider, and the Platform shall not be held liable for such actions.

5. Opening and Operating a Store

  • Only users who are citizens of the Republic of Türkiye and whose information has been verified may open a store.
  • The Seller is obliged to provide complete information in all listings and is responsible for grievances caused by missing information.
  • The Seller accepts the commission rate determined per sale.
  • If annual sales exceed legal thresholds, the Seller is responsible for fulfilling their income tax and/or other relevant obligations.

6. Messaging and User Interaction

  • Users are solely responsible for any content shared in their messages.
  • VitharBoost may limit messaging to prevent spam and ensure security.
  • Details regarding the sharing, retention, and security of personal data are set out in the Privacy Policy and the KVKK text.

7. Identity Verification

  • Members may be required to complete identity verification to benefit from certain services.
  • Submitted documents are accepted only through methods determined by VitharBoost.

8. Balance Top-Up, Earnings, and Refund Conditions

  • Balance top-ups are made only through payment institutions; unnotified or failed payments may not be reflected in the account.
  • Digital balances may be used only for on-site purchases and cannot be withdrawn as cash.
  • In the event of a Buyer/Seller dispute, the relevant balance may be blocked during the review period.
  • Refund requests are processed within the framework of legal procedures and service conditions. A refund may be possible provided that the balance has not been used.

9. Product or Service Return and Cancellation Terms

  • Returns are possible for defective or non-functional products/services. Other cancellation and return processes are carried out within the evaluation of VitharBoost and/or the relevant seller.
  • For digital products, returns are not possible after delivery.

10. Conduct and Sharing Rules

  • Users may not share content that discriminates based on social class, race, religion, sect, gender, region, and/or contains insults or hate speech.
  • The user who shares content is responsible for the content and opinions posted on the Platform.
  • The Member grants the Platform permission to use content uploaded to the Platform solely for providing services, moderation, and security processes, limited to the necessary technical use depending on the nature of the content.
  • Any rewarding for sharing ideas is entirely at VitharBoost’s discretion.

11. Promotion Codes and Giveaways

  • VitharBoost determines the duration, quantity, and validity conditions of promotion codes.
  • VitharBoost reserves the right to announce, change, or cancel promotions and giveaway results.

12. Privacy Policy, Data Use, and Cookies

  • User data may be processed for membership management, verification, legal obligations, customer support processes, and system improvement.
  • Personal information is not shared with third parties except for legal obligations and authorized official requests.
  • Cookies are used on the website for user experience and security purposes. Details are provided on the Cookie Policy page.

13. Limitation of Liability

  • VitharBoost is not directly responsible for the accuracy of content published on the Platform or for transactions between the Seller and the Buyer.
  • In force majeure events such as natural disasters, technical failures, and similar extraordinary circumstances, obligations may be suspended.
  • VitharBoost reserves the right to update its services and agreement terms in compliance with legislation; changes are announced on vitharboost.com.

14. Termination of the Agreement

  • This Agreement remains in force as long as the membership remains active. Relevant provisions continue to apply even if the membership is suspended or terminated.
  • Accounts of members who violate this Agreement may be suspended or terminated unilaterally by VitharBoost; damages may be claimed through legal means.

B) Disclosure Text and Privacy Policy (KVKK)

This disclosure text has been prepared to inform you about the processing, retention, and sharing of your personal data within the scope of the services provided on vitharboost.com operated by Yusuf Kacar Sole Proprietorship (“VitharBoost”).

Personal Data Processed:
  • Identity (Name-surname, date of birth)
  • Contact (Address, email, phone)
  • Location (IP and location data)
  • Customer Transaction (Orders, invoices, call center records)
  • Transaction Security (IP address, login/logout, password)
  • Marketing (Purchase history, surveys, cookie records, campaign information)
  • User Comments
Purposes of Processing:
  • Order and service delivery
  • Resolving system issues
  • Processing payments
  • Improving products and services
  • Marketing (if consent is provided)
  • Fulfilling legal obligations
  • Communication with official authorities
Transfer of Data:
  • Legally authorized institutions, business partners, and suppliers (only for the purposes above and within the legal framework).
Cookies:
  • Temporary and persistent cookies are used to improve user experience. Details on the cookie policy and management are stated separately on the website.
Rights of the Data Subject:
  • To exercise all your rights stated in Article 11 of KVKK, you may apply to [email protected]. Your request will be responded to within 30 days.
Data Security:
  • All personal data is protected with reasonable technical and administrative measures. Risks in the internet environment are known by the user.

I accept that my personal data listed below may be processed and, if necessary, transferred domestically and abroad, as explained in detail in the VitharBoost Disclosure Text and Privacy Policy. I know that I can withdraw my explicit consent at any time.

  • Receiving orders, providing/developing products and services, resolving system issues, marketing, membership management, legal obligations, and technical/logistical support.
